HD Career Consulting LLC dba WorkLife Wellness Lab and its agents may, from time to time, provide guidance or feedback to you as a client related to your overall goals, specific projects, or general conditions in your life or profession as these pertain to your goals for therapy, career coaching, or benefits planning. The scope and nature of services may include recommending priorities, setting goals, identifying resources, brainstorming, creating action plans, asking clarifying questions, continuous monitoring, and providing models, examples, and other forms of educational content related to your self-selected services.

Residency requirements and delivery of mental health services: Please note that all providers rendering mental health services are required to be authorized to provide such services within the state where you reside and where you plan to engage in services. It is your responsibility to ensure that the provider is licensed and able to offer services in your state.

Results will vary and there are no guarantees of specific outcomes or results. Please be advised that results will vary. Participants understand that each person, including themselves, has unique and varied circumstances that impact the results achieved. No one person's outcome and how they arrived at that outcome will be the same. Participants understand that success in this Program, Course, or Service is benchmarked against themselves and measured based on the goals set by the Participant. Participants acknowledge that HD Career Consulting LLC dba WorkLife Wellness Lab can only offer the tools to be used in helping you, the participant succeed in your self-professed goals. Therefore, making a commitment to the action plans you and your provider create is important.

Coaching, counseling, or treatment plans are not binding contracts or guarantees towards specific outcomes. These documents are learning tools and progress management tools used to monitor progress. They are in no way an agreement to guarantee a specific treatment or career or benefits outcome by any provider or agent or representative, nor do they constitute an agreement to provide specific results or outcomes in relation to the services rendered and results will inevitably very.

Disclaimer: Service outcomes may vary and are not guaranteed. Success depends on individual client goals and their active participation in the program.

Payment: Payment for services must be made in advance, payment method proof and a secured credit card on file is required before any services will be rendered or access to e-products will be released. WorkLife Wellness Lab reserves the right to delay or withhold services until payment is confirmed and processed. In addition, please be advised that payment for the intake appointment covers the screening process to determine the appropriateness of services. As such, intake fees are non-refundable, regardless of whether the client proceeds with further services. WE also reserve the right to change payment methods, policies and fees for services for any reason, at any time. Should a change be made you will be given at least a 30 day notice in writing. Fees: HD Career Consulting reserves the right to revise and publish updated prices as we see fit. Should prices changed or adjusted, you will be given at least 30 days’ notice via email to the email address of record on file. Informed Consent: Both you and our providers have the right to make informed decisions and may terminate the relationship at any time if concerns arise regarding therapy or coaching. Should your provider terminate, they will notify you in writing. To terminate services on your own, please email your provider directly or send an email to billing@wlwlab.com. Please be advised that you will be charged for the services per your financial agreement.

Indemnification and Limited Liability: By signing this document, you agree to indemnify, defend, and hold harmless the provider, its employees, agents, and affiliates from any claims, damages, losses, or expenses, including legal fees, arising out of or in connection with my engagement with the provider’s services, including but not limited to any third-party claims related to the services provided.

You understand and agree that the provider’s liability is limited to the amount paid for services rendered, and the provider shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, arising from your use of the services, regardless of the cause.

Binding Arbitration: By signing this document, you agree that any dispute, claim, or controversy arising out of or relating to the services provided, this agreement, or any breach thereof, shall be resolved exclusively through binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) and shall take place in Colorado. Both parties agree to waive their right to a trial by jury and to resolve any disputes in an arbitration setting. The decision rendered by the arbitrator(s) shall be final and binding, and judgment on the award may be entered in any court having jurisdiction thereof. day notice in writing.

Governing Law: These terms of use and policies outlined will be governed by and construed in accordance with the laws of the State of Colorado, with all disputes being litigated in the State Courts seated in Weld County, Colorado or the Federal Courts located in Denver, Colorado.

Modification of Agreement: This Agreement may be modified or replaced at WorkLife’s sole discretion, without any obligation to notify you. You are advised to routinely check this web page to review if and to what extent this Agreement has been changed. Your continued use of this website shall constitute your consent to any changes.

Entire Agreement: It is agreed that there is no representation, warranty, collateral agreement, or condition affecting this Agreement except as expressly provided in this Agreement.

Inurement: This Agreement will inure to the benefit of and be binding on the Parties and their respective heirs, executors, administrators, and permitted successors and assigns.

Severability: If any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

Waiver: The waiver by either Party of a breach, default, delay, or omission of any of the provisions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.

DEFINITIONS

“User,” “you”  “shall mean the person accessing the website for any purpose, who by accessing the website agrees to follow the Terms and has no obligation to purchase anything from the Site. A “client” or “participant” or “patient” is any individual who makes a payment, or whom a third party makes such payment, for a program, course, or service offered by HD Career Consulting LLC dba WorkLife Wellness Lab.Any Terms for particular services or purchases shall only apply should a Client or User directly or indirectly purchase such particular services or purchases.

Titles and Headings: Headings are inserted for the convenience of the Parties only and are not to be considered when interpreting this Agreement.
Gender: Words in the singular mean and include the plural, and vice versa. Words in the masculine mean and include the feminine, and vice versa.

TELEHEALTH-POLICIES

Telehealth and Remote Coaching/Counseling Expectations
Our Telehealth services are provided through electronic means, including video conferencing and secure communication platforms. While we take precautions to protect your privacy and adhere to legal and ethical standards, please note that the transmission of information online inherently carries some risks. We cannot guarantee the security of the technology you use on your end. By engaging in Telehealth services, you understand and accept these risks and consent to the electronic exchange of information for the purpose of receiving our services.

Access and Fees
All services are delivered via Telehealth, which requires clients to navigate online platforms for appointments, homework, and communication. You are responsible for the service fees even if you are unable to access the platforms. We can only serve clients within the state of Colorado. If you miss or cancel an appointment with less than 48 hours' notice, you will be charged in accordance with the financial agreement on file.

Technical Assistance
If you encounter technical issues during a session, please email us immediately at hello@wlwlab.com for assistance. We recommend verifying your internet connection and using a private, quiet space to ensure privacy and minimize distractions.

Technology Requirements: It is your responsibility to ensure you have the necessary technology to participate in telehealth services. Our platform and tools may change, and you will be informed in advance. More information is available at Technology Requirements.

EMERGENCY PROTOCOLS & LIMITATIONS OF TELEHEALTH

While our services are designed to be effective for a wide range of concerns, telehealth may not be suitable for all emergency situations. If you are in immediate danger or experiencing a mental health crisis, please contact 9-1-1 or a local crisis service:

Ensure you have a local emergency contact in case of urgent needs that arise during or outside of your scheduled sessions.

REFUND POLICY

Counseling and Coaching Services:
Once counseling or coaching services have been rendered, they are non-refundable. This includes all sessions conducted and any related work that has been completed.

Digital Products: Payment for digital products (e-books, online courses, downloadable content, or access to web-based content) is considered payment for viewing and accessing the product. Therefore, once the product has been accessed or viewed, it is non-refundable.

Refund Request Procedure
All refund requests for unopened or unviewed content, or services paid for, but not rendered by provider must be submitted in writing via email to billing@wlwlab.com. Refund requests will be reviewed by WorkLife Wellness Lab on a case-by-case basis. WorkLife Wellness Lab reserves the right to deny any refund request that does not meet the criteria outlined in this policy.

This Refund Policy may be subject to change without prior notice. WorkLife Wellness Lab reserves the right to make exceptions to this policy in rare and exceptional circumstances.

ACCESSIBILITY & INCLUSIVITY POLICY

WorkLife Wellness Lab is committed to ensuring equal access to services for all clients. If you require accommodations for any disabilities, please notify your provider in advance to discuss potential solutions. We will work with you to ensure that our services are accessible and meet your individual needs.

REFERRAL POLICY

At any point, if your needs extend beyond our scope of practice, we will provide you with a referral to appropriate professionals. We may recommend specialists such as psychiatrists, higher levels of care, or other relevant providers, depending on your situation.

DISCLAIMER FOR E-PRODUCTS

E-products and membership programs provided by WorkLife Wellness Lab are designed for educational purposes only. WorkLife Wellness Lab is not responsible for the individual application or outcomes beyond the content provided. These products include, but are not limited to, content produced and viewed online, downloadable materials sent via email, or content contained within the members-only community monitored by us. It is the client’s responsibility to ensure proper use of these products and seek professional guidance when necessary.

CLINICAL NOTES AI DISCLOSURE AND CONSENT TO USE

We use Clinical Notes ai for clinical documentation, and for process and performance improvement. By engaging in services with WorkLife Wellness Lab, you consent to the use of a Clinical Documentation Assistance Tool, powered by Clinical Notes AI, by your provider. This tool is utilized to assist in creating accurate and efficient clinical notes based on the content of your sessions. The use of this tool enhances the quality of documentation, supports efficient care delivery, and ensures compliance with privacy standards. All notes generated using this tool are reviewed by your provider and maintained in accordance with HIPAA regulations.

Clinical Notes ai Tool Functionality Disclosure: The tool converts our conversations into notes and clinical documentation. - It uses speech to text technology to create a transcript of our interactions and deletes the transcript once the note or document has been created.

Clinical Notes ai Data Retention Policy

Audio is not stored in any system - Transcripts are de-identified with any personal information and disassociated with the record after 14 days. Clinicians may save notes for longer as part of your medical record.

HIPAA Compliance and Patient Data Rights apply to Clinical Notes ai data: - Clinical Notes ai adheres to HIPAA standards, ensuring the security and confidentiality of your health information.

SCHEDULING POLICIES

All services are provided via telehealth, requiring clients to navigate online platforms for appointments, homework, and communications. If you cannot access these platforms, you are still responsible for the service fees. We cannot serve clients outside the state of Colorado. If you miss or cancel an appointment with less than 48 hours' notice, you will be charged according to the financial agreement on file.

Rescheduling Appointments:

If you miss or cancel an appointment with less than 48 hours' notice, you must work with your provider to reschedule. Late cancellations and no-shows may be subject to a cancellation fee as outlined in your financial agreement with us. Questions about cancellation or missed appointment fees can be emailed to billing@wlwlab.com. Please be advised that clients with chronic no-shows and late cancellations may be at risk of dismissal from the practice, and such dismissal is at the discretion of the provider.

No Response Policy:

A "no response" occurs when a client fails to reply to multiple attempts by their provider to communicate, schedule, or reschedule appointments. If a client does not respond to communication efforts within 45 days, attempts to reschedule will cease, and the client will be removed from the provider’s caseload. It is the responsibility of the client to re-engage and establish services. If the client does not engage within 60 days from the last contact, continued lack of engagement will be considered a breach of the terms of service, and the provider reserves the right to terminate the professional relationship at their discretion. Re-engagement beyond 60 days will require proactive communication from the client.

Note: This timeframe may be adjusted or modified based on third-party agency agreements between WLWLAB and another provider rendering services to the client.

COMMUNITY STANDARDS AND DISMISSAL POLICIES

As a client, you agree to engage respectfully with WorkLife Wellness Lab professionals, adhering to community standards that promote healthy relationships in both work and personal life. Dismissals may occur due to failure to engage, non-compliance with treatment plans, safety risks, boundary violations, lack of progress, or repeated missed appointments. If dismissal occurs, you will be notified regarding the reason for dismissal in writing and referred to appropriate resources. Services may still be charged as per your financial agreement regardless of the reason for dismissal.

Privacy & Security:

By attending online sessions, you acknowledge the inherent privacy risks. We uphold strict confidentiality but cannot be held liable for any privacy breaches on your side of the connection. For privacy protection tips, refer to our Telehealth Policy. We enforce a no-recording policy for all sessions involving health or personal information.

WorkLife Wellness Lab adheres to HIPAA standards to ensure the security and confidentiality of your health information.

Data Storage and Retention: All records, including those generated by Clinical Notes AI, and stored in our electronic health record system are stored securely and maintained in accordance with HIPAA regulations. Audio files are not stored in any system, and transcripts are de-identified and disassociated from your personal information after 14 days.

Confidentiality:

Confidentiality is of utmost importance in our practice, and we adhere to strict ethical and legal standards to protect your privacy. Information shared during therapy sessions is kept confidential, with a few exceptions outlined in our confidentiality policy. Provisionally licensed professionals follow the same confidentiality standards as fully licensed professionals, ensuring that all interactions respect client privacy.

Feedback and Advocacy:

Your feedback is valuable to us, and we encourage open communication throughout your treatment experience. If you have any concerns, questions, or feedback about the services provided or your interactions with our staff, please don't hesitate to share them with your provider directly or, if . If you are dissatisfied with your services, please notify your provider directly or complete complete our Feedback form and we will route your concern to the appropriate manager.

BEHAVIORAL HEALTH PROVIDER DISCLOSURE

We offer a variety of mental health services, including therapy, coaching, and benefits counseling. Our team includes licensed professionals and provisionally licensed counselors supervised by fully licensed clinicians. All professionals maintain appropriate qualifications and certifications, and supervision ensures the quality of care. You have the right to choose your provider and service type, with confidentiality upheld at all stages.

Options for Behavioral Healthcare Provider Disclosure: As a client of our practice, you have the right to choose the type of services you receive and the professional you work with. You may request to be seen by a fully licensed mental health professional or a provisionally licensed professional under supervision, based on your preferences and needs. We will work collaboratively with you to ensure that your treatment plan aligns with your goals and expectations.

  • Provisionally Licensed Professionals include Licensed Professional Counselor Candidates [LPCCs] and Licensed Social Workers [LSWs]: Provisionally licensed professionals are individuals in the process of obtaining full licensure and are licensed in the state of Colorado to provide mental health counseling and work under the supervision of fully licensed clinicians to gain additional applied clinical experience. Provisionally licensed professionals may provide direct services to clients, but their work is closely monitored and supervised by experienced professionals.

  • Fully Licensed Professionals include Licensed Professional Counselors [LPCs] and Licensed Clinical Social Workers [LCSWs]: Fully licensed professional counselors have obtained their 2,000-3,000 post-graduate applied experience in clinical practice and are authorized in the State of Colorado to practice mental health with supervision. However, these individuals are required to complete ongoing annual professional training to maintain their license.

  • Behavioral Health Supervision: Supervision is an integral part of our practice, ensuring that provisionally licensed professionals receive guidance, support, and oversight as they work with clients. Supervision involves regular meetings between the provisionally licensed professional and their supervisor to discuss cases, review treatment plans, and ensure the quality of care provided.

WEBSITE & INTERNET DISCLOSURES

The website of HD Career Consulting LLC dba WorkLIfe Wellness Lab (“Us”, “We,”“WorkLife,” "WLWLAB" , “HDCC”) owns and operate the website of worklifewellnesslab.com, as well as the various webpages under the WorkLife or HDCC name, (collectively, the “WorkLife sites”). These Disclosures, Terms and Agreement (the “Terms”) apply to your use of this website, as well as to any purchases of the WorkLife services through the WorkLife Sites. By using this website you affirm that you have reviewed and understand these terms disclosed here and that you agree, without limitation or qualification, to be bound by these Terms.

INTELLECTUAL PROPERTY & COPYRIGHTS DISCLOSURE

All intellectual property, such as but not limited to copyrights, patents, trademarks, or trade secrets whether registered or not, and related material (the "Intellectual Property") that is made available on a WorkLife website is owned by WorkLife or a third party from who the Intellectual Property is appropriately licensed or granted for a particular use.

The client is granted a non-exclusive limited-use license of this Intellectual Property for the purpose of accessing, using, or participating through the WorkLife Website. Title, copyright, intellectual property rights, and distribution rights of the Intellectual Property remain exclusively with the HD Career Consulting LLC dba WorkLIfe Wellness Lab.

You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course unless we give you explicit permission to do so in a written agreement signed by a WorkLife authorized representative. This also applies to content you can access via any of our APIs.

The content prepared and provided in and throughout the course of services and through other channels used to produce and share content is produced and owned by HD Career Consulting LLC dba WorkLife Wellness Lab and all rights are reserved. Replication of this content is expressly prohibited. The Program, Course, or Service or course or service may only be accessed by the individual who is the customer on record with HD Career Consulting LLC dba WorkLife Wellness Lab.

A Program, Course, or therapeutic or Coaching Service including usernames and passwords, may only be used by the client as permitted herein and may not be sold or distributed without the HD Career Consulting LLC dba WorkLife Wellness Lab expressed written consent.

Acknowledgment and Agreement:

By electronically signing this document, I acknowledge, agree to the terms, and give consent to the terms or use, conditions, and policies outlined herein. I understand that failure to engage with the provider may result in termination of services and that these policies may be updated based on third-party agency agreements.
