HD Career Consulting LLC dba WorkLife Wellness Lab is a 100% Telehealth located in the state of Colorado and is comprised of an interdisciplinary team that provides services including, but not limited to career development and mental health education, career coaching, return to work benefits planning for individuals who are receiving public benefits due to disability, and mental health professional individual counseling.
INDEMNIFICATION: Except to the extent paid in settlement from any applicable insurance policies, and to the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party, and its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees, and costs of any kind or amount whatsoever, which result from or arise out of any act or omission of the indemnifying party, its respective directors, shareholders, affiliates, officers, agents, employees, and permitted successors and assigns that occurs in connection with this Agreement. This indemnification will survive the termination of this Agreement.
Modification of Agreement: This Agreement may be modified or replaced at WorkLife’s sole discretion, without any obligation to notify you. You are advised to routinely check this web page to review if and to what extent this Agreement has been changed. Your continued use of this website shall constitute your consent to any changes.
Entire Agreement: It is agreed that there is no representation, warranty, collateral agreement, or condition affecting this Agreement except as expressly provided in this Agreement.
Inurement: This Agreement will inure to the benefit of and be binding on the Parties and their respective heirs, executors, administrators, and permitted successors and assigns.
Severability: If any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.
Waiver: The waiver by either Party of a breach, default, delay, or omission of any of the provisions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.
Service Limitations: Telehealth counseling may not be suitable for all individuals or conditions. We reserve the right to determine the appropriateness of this service for each client's needs.
Governing Law: These terms of use and policies outlined will be governed by and construed in accordance with the laws of the State of Colorado, with all disputes being litigated in the State Courts seated in Weld County, Colorado or the Federal Courts located in Denver, Colorado.
Privacy: We adhere to all relevant data protection and privacy laws, including HIPAA compliance for clients in the United States. However, if you are outside the United States, you should be aware of your own country's data protection laws.
Records and Storage: Your counseling records are confidential and securely stored. You may request access to your records in accordance with relevant laws.
DEFINITIONS: “User,” “you” “shall mean the person accessing the website for any purpose, who by accessing the website agrees to follow the Terms and has no obligation to purchase anything from the Site. A “client” or “participant” or “patient” is any individual who makes a payment, or whom a third party makes such payment, for a program, course, or service offered by HD Career Consulting LLC dba WorkLife Wellness Lab.Any Terms for particular services or purchases shall only apply should a Client or User directly or indirectly purchase such particular services or purchases.
Titles and Headings: Headings are inserted for the convenience of the Parties only and are not to be considered when interpreting this Agreement.

HD Career Consulting LLC dba WorkLife Wellness Lab and its agents may, from time to time, provide guidance or feedback that may address the participant's stated overall goals, specific projects, or general conditions in the participant's life or profession as it relates to their career development, or mental health. The scope and nature of services may include recommending setting priorities, establishing goals, identifying resources, brainstorming, creating action plans, asking clarifying questions, and providing models, examples, and other forms of educational content for information purposes only in the form of courses, one to one coaching or counseling sessions, or within communities managed by HD Career Consulting LLC dba WorkLife Wellness Lab. Provider Credentials: Please note that providers rendering mental health services must be licensed with in the state in which they are authorized to practice mental health. Upon intake you will be given a provider disclosure and agreement for your records and for your review.

Telehealth and Remote Coaching and Counseling Expectations. Please be advised that our Telehealth services are provided through electronic means, such as video conferencing and secure communication platforms. While we strive to ensure the confidentiality and security of these interactions, it's important to acknowledge that, like any online communication, there may be risks associated with the electronic transmission of information. We take all necessary precautions to protect your privacy and adhere to legal and ethical standards, but we cannot guarantee the security of the technology you use on your end. By choosing to engage in Telehealth services with us, you understand and accept the inherent risks and consent to the electronic exchange of information for the purpose of providing you with our services.
Results will vary and there are no guarantees of specific outcomes or results. Please be advised that results will vary. Participants understand that each person, including themselves, has unique and varied circumstances that impact the results achieved. No one person's outcome and how they arrived at that outcome will be the same. Participants understand that success in this Program, Course, or Service is benchmarked against themselves and measured based on the goals set by the Participant. Participants acknowledge that HD Career Consulting LLC dba WorkLife Wellness Lab can only offer the tools to be used in helping you, the participant succeed in your self-professed goals. Therefore, making a commitment to the action plans you and your provider create is important.
Coaching, counseling, or treatment plans are not binding contracts or guarantees towards specific outcomes. These documents are learning tools and progress management tools used to monitor progress. They are in no way an agreement to guarantee a specific treatment or career or benefits outcome by any provider or agent or representative, nor do they constitute an agreement to provide specific results or outcomes in relation to the services rendered and results will inevitably very.
Informed Consent: We also uphold the industry standard of respecting informed choice. You, as well as our providers, coaches, and planners, have the right to exercise informed choice. If, at any time, the therapeutic relationship is not working and there seems to be no foreseeable resolution, all parties have the right to terminate the relationship at any time.
We do not offer crisis mental health support and do not provide immediate or urgent crisis interventions outside scheduled and planned appointments. If you are in immediate danger or at risk of harming yourself or someone else, it is important that you contact 9-1-1 for immediate assistance.
If you are experiencing a Mental Health Crisis that requires immediate attention outside of an existing appointment schedule, we cannot guarantee an immediate or urgent appointment, so it is important that you contact a crisis support service to assist you. ACCESSING YOUR APPOINTMENT, TELEHEALTH RECORDS, COMMUNICATIONS, SCHEDULING AND BILLING. All services offered are provided via our telehealth platform and require that the participant, who from time to time may also be referred to as the client, patient or student must be able to successfully navigate the internet and the computer for the purpose of attending their appointment online via our selected teleconference services provider, engage online with assigned homework, patient portal and scheduling tools. In the event that a client is not being able to access technology and fully participate in sessions, due to no of the fault the provider; the client will still be responsible for the total allowable fee for their scheduled session, per the most up to date financial agreement on file. All services rendered are by providers with the skills, training and required licenses and certifications required by the state of Colorado. We are not able to take mental health clients who reside outside of a provider's state in which they are authorized to practice.
NO CALLS/NO SHOWS WITH LESS THAN 24 HOURS WRITTEN NOTICE: You will be subject to the latest published no show/late cancellation policy and charged the maximum fee allowable per your financial agreement. WE HAVE A “NO RECORDING” POLICY. We want you to know upfront that your privacy is important to us. Therefore, we have a no recording policy that applies to our mental health, benefits planning sessions and career coaching sessions, where there is a risk that we may be discussing or sharing information about your health in any capacity.
TAKING A SESSION IN AN UNSECURED LOCATION IS HIGHLY DISCOURAGED AND PROVIDERS ARE NOT OBLIGATED TO CONTINUE THE SESSION IF YOU ARE IN AN UNSECURED LOCATION. Should your provider and you both consent to continuing a session in an unsecured location, your provider and/or WorkLife Wellness Lab cannot be held liable for being overheard or any self-disclosure of HIPPA protected information throughout the course of your session.
SESSIONS TERMINATED DUE TO A CLIENT NOT BEING IN COMPLIANCE WITH THESE POLICIES WILL STILL BE CHARGED THE SESSION FEE TO THE MAXIMUM ALLOWABLE FEE, PER YOUR CARRIER OR PAYOR AGREEMENT AND PAYOR TYPE. ALL OFFENSES WILL BE COUNSELED ONCE AND THEN SUBJECT TO DISMISSAL FROM PRACTICE AT THE DISCRETION OF THE PROVIDER ON A CASE BY CASE BASIS.

RESCHEDULING A MISSED OR LATE CANCELLED APPOINTMENT:You are to work directly with your provider to reschedule if you wish to take advantage of the no show/late cancellation rescheduling policy outlined in your financial agreement. Individuals who reschedule and attend their appointment within 5 days of their missed appointment may be eligible for a partial cancellation fee credit to be applied to their rescheduled appointment only. You will need to work with your provider to determine eligibility at the time you are notified that you missed your appointment without notice or cancelled less than 24 hours from your originally scheduled appointment.
WE USE SECURE PLATFORMS: This means that will require you to verify your identity each time you access our platforms. We use Zoom which is HIPPA approved and secure. You will receive a link from us in the method you have authorized us to communicate with you on. You can also log into your patient portal to access your appointment link. We use AdvancedMD, which has end to end encryption, where all your patient records are stored and how you will access your patient portal. They are password protected and user access is managed.

To ensure you are online activity including accessing your records and appointments through your patient portal, we recommend that you use a secure and private internet connection, such as a password-protected Wi-Fi network or a virtual private network (VPN), to prevent unauthorized access to your session.
Providers require that you attend your telehealth appointment in a quiet and private location where you won't be overheard or interrupted. Avoid public spaces where others can potentially overhear your conversation. Taking your appointment in an unsecured place means that you are not protected by HIPPA should others overhear your appointment with your therapist or Coach.

we image that it is likely you are wanting to record your session because you are eager to learn and retain information you are getting in your sessions. However, recording your sessions opens you up to all kinds of risk to your privacy, and your confidentiality. This also means recording your session threatens your right to patient therapist confidentiality in the event that a third party were to get involved for any reason. It can also open you up to legal repercussions, that you are not aware of. So I best practice recommendation is to just not do it. Instead, express your concerns to your provider about wanting to remember and use the information you are learning, and devise a plan to obtain supplemental materials that will aid you best for time to come along your WorkLife Journey.
We will never send you unsolicited information about your appointment or your records. All paperwork we require you to complete takes place in the patient portal. Do not give out your medical information or personal identifiable data such as data of birth, social security numbers and addresses over an unsecured messaging system such as a text message or email or call over the phone without first confirming directly with the requestor. In our case, if you are ever concerned about requests like these that involve what looks like to be us you can contact us directly at 970-822-7866 to clarify. Be sure to confirm the identity of your healthcare provider and ensure that you're joining the session through the correct link or invitation to avoid potential phishing scams or impersonation.
If you need to share documents or files during the session, use secure file-sharing methods provided by the telehealth platform or encrypt the files before sending them.
